These Terms of Use govern your use of PokerFolio ("the app"), published by Apuri Studio Inc. ("we," "our," "us"), a Canadian federal corporation incorporated under the Canada Business Corporations Act, with its registered office at 350 Bay St, Suite 1300B, Toronto, Ontario M5H 2S6. By downloading, installing, or using the app, you agree to these terms. If you don't agree with them, don't use the app.
You must be 18 or older to use the app. PokerFolio is built for adults who play poker and want a record of it, and we don't make it available to anyone under 18. If we learn that someone under 18 is using the app, we may end their access. Being old enough to use PokerFolio is not the same as being old enough to gamble where you live — that's a separate question, and it's yours to answer.
PokerFolio is a personal record-keeping and study tool for poker players. It tracks the sessions and hands you enter, keeps a bankroll history, and provides calculators — equity, ICM, variance simulation, range building — that run on the information you give them. It does not deal cards, run games, accept wagers, or move money. It does not connect to any poker room or online site, and no part of the app is real-money play.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use PokerFolio on devices you own or control, for your own personal use. That's the whole of what you get: the app itself — its code, design, name, and content — stays ours, and nothing here transfers ownership of it to you. Your licence lasts as long as you follow these terms.
Premium features are offered via auto-renewing subscription, billed through the store you bought from — your Apple App Store account on iOS, or your Google Play account on Android. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel yours anytime in your device's App Store account settings, or under Payments & subscriptions in the Google Play app. Refunds are handled by whichever store took the payment, under Apple's or Google Play's own refund policies — we don't process refunds directly.
Cancelling stops the next renewal; it doesn't shorten the period you've already paid for, and you keep premium features until that period ends. The price and billing period are shown in the store before you confirm the purchase. If we change the price of an ongoing subscription, the store will tell you and ask you to agree before it takes effect. We may change which features are included in a plan as the app develops, but we won't take away the core of what you subscribed for during a period you've already paid for.
Promotional codes offered by partners may apply a discount to a subscription for a limited time, as configured for that specific code. Codes are non-transferable, have no cash value, and may be restricted or discontinued at any time.
The hands, sessions, locations, opponent notes, and everything else you enter into PokerFolio belong to you. We don't claim ownership of any of it, and we don't sell it. Nearly all of it stays on your device and is never sent to us at all — our Privacy Policy sets out the handful of things that do leave your phone and why.
Because your data lives on your device, keeping a copy is worth doing. Uninstalling the app, losing the device, or clearing the app's data removes it, and we have no copy to restore from. The app's CSV export exists for exactly this reason.
When you share a hand, PokerFolio uploads that single hand to our server and gives you a link to a replay of it. Anyone who has that link can open the replay. There's no account, no password, and nothing else standing between the URL and the hand. Whoever you send it to can forward it, post it, or paste it anywhere, and messaging apps may show a preview of it. We don't publish a directory of shared hands, but a share link is not a secret — treat sharing a hand as publishing it.
A replay carries the hand only: the cards, the actions, the amounts, the stakes, the table size, and the currency. Your session history, bankroll, locations, and opponent notes are never part of it. Sharing a hand gives us the permission we need to store and serve that hand so the link works, and nothing beyond that. If you want a shared hand taken down, email us the link and we'll delete it.
PokerFolio records and analyses poker you played somewhere else. It is not a gambling service, and using it is not gambling. Whether you may legally play poker for money, and on what terms, depends on where you are, and complying with that is your responsibility.
Nothing in the app is financial, investment, tax, accounting, or legal advice. We're not licensed to give any of it, and the figures the app produces aren't a substitute for a professional who knows your circumstances. Reports and exports the app generates may help you prepare your own tax filings, but they aren't tax documents and we make no representation that they meet the requirements of any tax authority.
Every number PokerFolio shows is computed from the data you entered and the assumptions you chose. Variance simulations, risk-of-ruin figures, bankroll recommendations, ROI, expected value, equity, and ICM results describe a model — they don't forecast what will happen at the table, and they can't tell you what is safe to risk. Poker results swing hard over the short run, your own past results are not a reliable guide to your future ones, and a model built on a small or unrepresentative sample will be confidently wrong. Decisions about how you play and how much you put at risk are yours alone.
The app is provided "as is" and "as available," without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the app will be error-free or uninterrupted, that its calculations are free of bugs, that it will be compatible with a future version of your operating system, or that data stored on your device won't be lost. Some jurisdictions don't allow the exclusion of certain warranties; where that's the case, this section applies to you only as far as the law allows.
To the maximum extent permitted by law, we're not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost poker winnings, lost data, or lost opportunity, arising out of or relating to your use of the app — including any decision you made on the strength of a figure it produced. Our total liability for all claims relating to the app is limited to the greater of the amount you paid for PokerFolio subscriptions in the twelve months before the claim arose, or CAD $50.
Nothing in this section limits liability that the law does not permit us to limit, including liability for fraud, or for death or personal injury caused by our negligence.
If someone brings a claim against us because of how you used the app — content you shared through it, a law you broke while using it, or someone else's rights you infringed — you agree to defend us against that claim and to cover the reasonable costs and damages that come out of it. This doesn't apply to any part of a claim caused by our own conduct.
We may update these terms as the app changes or the law requires. The date at the top of this page tells you when they were last revised. Where a change is significant and we can reasonably give notice, we'll flag it in the app or on this page before it takes effect. Continued use of the app after a change means you accept the updated terms; if you don't accept them, stop using the app and cancel any subscription through your store.
You can end these terms at any time by cancelling your subscription through your store and deleting the app. We may suspend or end your access if you materially break these terms, or if we stop offering PokerFolio — and if we discontinue the app during a subscription period you've paid for, you can seek a refund through the store that billed you. The sections on ownership, your content, disclaimers, limitation of liability, indemnity, and governing law survive the end of these terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over disputes arising from them.
That choice doesn't take away the consumer-protection rights you have where you live. If the law of your own country, province, or state gives you rights or remedies that a contract isn't allowed to remove — Ontario's Consumer Protection Act does exactly that for people in Ontario, and many other places have equivalents — those rights stand, whatever these terms say. Nothing here is meant to waive them, to require you to give up a claim you could otherwise bring at home, or to stop you from raising a complaint with a regulator.
